REFUND POLICY 

By clicking the “I ACCEPT” button you agree and give legal consent that no refund will be made, after Notarybd Services and enlisted notary public of Notarybd Services deliver you complete service. Once you have placed an order and accordingly pay invoice amount and later you decide not to receive service or unable to receive service, then the service charge you pay will not be refunded. 

You cannot switch / change from one service to another, until you complete the transaction of the first service. For Example- If you select Document Notarization and pay associated service charge for it, until you receive notarized document i.e. until you complete your first service, you cannot switch / change category from document notarization to an affidavit service or vice-versa OR If you select affidavit service and pay associated service charge for it, until you receive affidavit service i.e. until you complete your first service, you cannot switch / change affidavit service to document notarization or vice-versa. Further, you cannot withdraw service until final completion of full service. For Example- If you select Affidavit (Draft) and Execution Online, after approving final draft of an affidavit, you cannot withdraw service until completion of an affidavit execution. In that case, the service charge you pay will not be refunded. 

If you place your order by using a third party’s Valid Card or through Net-Banking or otherwise through any mode of payment mechanism without prior approval or permission of the third party or if you stole, misuse / abuse, misrepresent information or identity of the Valid Card or other mode of payment mechanism of third party, in that event you and your associate (if any) will be solely or jointly responsible and liable for such offence and future consequence and the service charge that will pay be non-refunded. 

By clicking the “I ACCEPT” button you do hereby agree that after you have made payment, if Notarybd Services and enlisted notary public of Notarybd Services is unable to deliver you the service or service be delayed due to circumstances beyond our reasonable control, including without limitation fire, strikes, insurrection, riots, embargos, regulations of any civil authority, act of God, flood or technical or technological error or unwanted interruption or server down or any network breach or breakdown or unavoidable circumstances, in that event, you cannot directly or indirectly claim charge back or refund or compensation. In such circumstances, Notarybd Services and enlisted Notary Public of Notarybd Services will deliver you the service as soon as the circumstances becomes normal and/or our platform is ready to use. 

In normal circumstances, except for above mentioned beyond control reasons, if Notarybd Services and enlisted notary public of Notarybd Services is unable to deliver you the complete service for any other reason whatsoever, then full invoice amount will be refunded to you unconditionally within 15-30 working days from the date of failure to deliver you service. You cannot directly or indirectly claim any interest and / or compensation due to undelivered of service. 

Further, in the case of an affidavit service after you have made payment and approve final draft of an affidavit, then you will book an appointment schedule online within next 72 hours and during first appointment date of two-way live audio-video affidavit signing and execution virtual session online, if the session is canceled / terminated or delay from either side due to circumstances beyond reasonable control, including but not limited to fire, strikes, insurrection, riots, embargos, restriction by court order or government authority, act of God, flood or technical or technological error or unwanted interruption or server down or any network breach or breakdown or unavoidable circumstances, then you will make re-appointment schedule online within next one month. In such event, you cannot directly or indirectly claim charge back or refund or compensation. If you do or do so, it will be considered a breach of your consent and terms of this refund policy and legally rejected in all Courts.

In the case of an affidavit service, in normal circumstances other than the reason(s) as stated herein above, if you fail to appear on first appointment schedule date or if you cancel your first appointment schedule due to any reason whatsoever, in that case, you will be given one opportunity to take second and final schedule online within one month from the date your first appointment schedule. If you fail to take re-schedule i.e. second schedule date within specific time frame or after taking your second appointment schedule date, if you fail to appear in  second appointment date or if you cancel your second appointment for any reason whatsoever, then the service charge you pay will be non-refundable and forfeited. In that event, you cannot not claim charge back or refund or compensation. If you do or do so, it will be considered a breach of your consent and terms of this refund policy and legally rejected in all Courts. In that case, you have to place new order online and pay service charge again and book new appointment schedule online. 

If enlisted Notary Public of Notarybd Services fails to appear on first or second appointment schedule date due to any reason whatsoever, in that case, you will be given re-schedule by the Notary Public. In that event, you cannot not claim charge back or refund or compensation. If you do or do so, it will be considered a breach of your consent and terms of this refund policy and legally rejected in all Courts.

This legal consent and terms of this refund policy are to be construed as part of “Terms of Service and Use” signed by you. 

By clicking the “I ACCEPT” button you agree that your electronic signature to this legal consent and terms of this refund policy is just as valid and legally binding on you as your pen and ink signature and you agree to be legally bound by this electronic signature.

আমি গ্রহন করলাম বাটনে ক্লিক করার মাধ্যমে আপনি এই মর্মে রাজী ও আইনগত সম্মতি প্রদান করছেন যে, আপনাকে নোটারীবিডি সার্ভিসেস ও নোটারীবিডি সার্ভিসেস এর তালিকাভূক্ত নোটারী পাবলিক কর্তৃক পূর্ণাঙ্গ সার্ভিস প্রদানের পর আপনার পরিশোধিত সার্ভিস চার্জ অফেরৎযোগ্য। আপনি অর্ডার প্রদানের পর এবং সে অনুসারে ইনভয়েস-এ বর্ণিত সার্ভিস চার্জ  পরিশোধের পর, তৎপরবর্তীতে আপনি যদি সার্ভিস গ্রহন করতে না চান বা সার্ভিস নিতে ব্যর্থ হন, সেক্ষেত্রে আপনি যে সার্ভিস চার্জ পরিশোধ করবেন তা অফেরযোগ্য হবে।   

আপনি প্রথম সার্ভিস সম্পন্ন না করা পর্যন্ত এক সার্ভিস হতে অন্য সার্ভিস পরিবর্তন করতে পারবেননা। উদাহরনসরূপ- আপনি যদি ডকুমেন্ট নোটারী সার্ভিস নির্বাচন করেন এবং এজন্য সংশ্লিষ্ট খরচ পরিশোধ করেন, আপনি নোটারীকৃত ডকুমেন্ট গ্রহন না করা পর্যন্ত অর্থ্যাৎ প্রথম সার্ভিস সমাপ্ত না করা পর্যন্ত আপনি ডকুমেন্ট নোটারী সার্ভিস না নিয়ে এফিডেভিট সার্ভিস নিতে পারবেন না বা বিপরীতভাবে অথবা আপনি যদি এফিডেভিট সার্ভিস নির্বাচন করেন এবং এজন্য সংশ্লিষ্ট খরচ পরিশোধ করেন, আপনি নোটারীকৃত এফিডেভিট গ্রহন না করা পর্যন্ত অর্থ্যাৎ প্রথম সার্ভিস সমাপ্ত না করা পর্যন্ত আপনি এফিডেভিট সার্ভিস না নিয়ে ডকুমেন্ট নোটারী সার্ভিস নিতে পারবেন না বা বিপরীতভাবে। তাছাড়া আপনি আংশিক সার্ভিস গ্রহন করার পর সার্ভিস প্রত্যাহার করতে পারবেননা। উদাহরনসরূপ- আপনি যদি এফিডেভিট (ড্রাফট) ও সম্পাদন নির্বাচন করেন, পরবর্তীতে আপনি এফিডেভিটের চুড়ান্ত ড্রাফট অনুমোদন ও গ্রহন করার পর, ড্রাফটকৃত এফিডেভিট চুড়ান্তভাবে অনলাইনে সম্পাদন করা ব্যতীত সার্ভিস প্রত্যাহার করতে পারবেননা। সেক্ষেত্রে আপনার পরিশোধিত সার্ভিস চার্জ অফেরৎযোগ্য হবে।

আপনি যদি তৃতীয় পক্ষের পূর্ব অনুমোদন ব্যতীত তৃতীয় পক্ষের বৈধ কার্ড বা নেট ব্যাংকিং বা অন্যথায় অর্থ প্রদানের যেকোন পদ্ধতির মাধ্যমে অর্ডার দেন অথবা আপনি যদি তৃতীয় পক্ষের বৈধ কার্ড চুরি করেন বা কার্ড অপব্যবহার করেন বা বৈধ কার্ডের পরিচয় বা তথ্য অপব্যবহার করেন বা তৃতীয় পক্ষের অর্থ প্রদানের যেকোন পদ্ধতির অপব্যবহার করেন সেক্ষেত্রে আপনি ও আপনার সহযোগী (যদি কেউ থাকে) এককভাবে বা যৌথভাবে উক্ত অপরাধের ও ভবিষ্যৎ পরিণতির জন্য দায়বদ্ধ থাকবেন। সেক্ষেত্রে আপনার পরিশোধিত সার্ভিস চার্জ অফেরৎযোগ্য হবে।

”আমি গ্রহন করলাম” বাটনে ক্লিক করার মাধ্যমে আপনি অধিকতর রাজী ও আইনগত সম্মতি প্রদান করছেন যে, আপনি সার্ভিস চা‍র্জ পরিশোধ করার পর যদি নোটারীবিডি সার্ভিসেস ও এর তালিকাভূক্ত নোটারী পাবলিক যদি যুক্তিসঙ্গত নিয়ন্ত্রনের বাইরে পরিস্থিতির কারনের মধ্যেই শুধু সীমাবদ্ধ নয় যার অন্তভূর্ক্ত আগুন বা দৈব দূর্ঘটনা বা ধর্মঘট, বিদ্রোহ, বন্যা, দাঙ্গা, আদালেতের আদেশ বা সরকারী নিষেধাজ্ঞা বা টেকনিক্যাল বা প্রযুক্তিগত ত্রুটি বা নেটওয়ার্ক কাটা বা নেটওয়ার্ক ডাউন বা অযাচিত বাধা বা সার্ভার ডাউন বা অনিবার্য কারনে সার্ভিস প্রদান করতে না পারেন বা সার্ভিস প্রদানে বিলম্ব হয়, সে পরিস্থিতিতে আপনি প্রত্যক্ষ বা পরোক্ষভাবে পরিশোধিত সার্ভিস চা‍র্জ ফেরৎ বা কোন ক্ষতিপূরন দাবী করতে পারবেন না। সেক্ষেত্রে নোটারীবিডি সার্ভিসেস ও আমাদের তালিকাভূক্ত নোটারী পাবলিক যতদ্রুত সম্ভব পরিস্থিতি স্বাভাবিক এবং / বা আমাদের প্ল্যাটফর্ম ব্যবহারের উপযোগী  হওয়ার পর সার্ভিস ডেলিভার করবেন।

উল্লেখ্য, উপরে উল্লেখিত কারন ব্যতীত স্বাভাবিক পরিস্থিতে নোটারীবিডি সার্ভিসেস ও এর তালিকাভূক্ত নোটারী পাবলিক আপনাকে যদি ইনভয়েস এ বর্নিত সার্ভিস অন্য যেকোন কারনবশতঃ সম্পূর্ন প্রদানে ব্যর্থ হয় সেক্ষেত্রে আপনার পরিশোধিত সকল সার্ভিস চার্জ আপনাকে সার্ভিস প্রদানে ব্যর্থতার তারিখ হতে পরবর্তী ১৫-৩০ কর্ম দিবসের মধ্যে নিঃশর্তে আপনাকে ফেরৎ প্রদান করা হবে। সেক্ষেত্রে আপনি সার্ভিস না পাওয়ার কারনে প্রত্যক্ষ বা পরোক্ষভাবে সার্ভিস চার্জ ফেরৎ বা কোন সুদ এবং / বা কোন ক্ষতিপূরন দাবী করতে পারবেন না।   

আমি গ্রহন করলাম বাটনে ক্লিক করার মাধ্যমে আপনি অধিকতর রাজী ও আইনগত সম্মতি প্রদান করছেন যে, এফিডেভিট সা‍র্ভিসের ক্ষেত্রে আপনি সার্ভিস চার্জ পরিশোধ করার পর, আপনি এফিডেভিটের ড্রাফট চুড়ান্ত অনুমোদনের তারিখ হতে পরব‍‍র্তী ৭২ ঘন্টার মধ্যে এফিডেভিট সম্পাদনের জন্য অনলাইনে প্রথম সাক্ষাৎকার তারিখ নিবেন। অনলাইনে দ্বি-মুখী সরাসরি এফিডেভিট স্বাক্ষর ও সম্পাদন অডিও-ভিডিও ভা‍র্চুয়াল সেশন চলাকালীন সময়ে যদি যুক্তিসঙ্গত নিয়ন্ত্রনের বাইরে পরিস্থিতির কারনের মধ্যেই শুধু সীমাবদ্ধ নয় যার অন্তভূর্ক্ত আগুন বা দৈব দূর্ঘটনা বা ধর্মঘট, বিদ্রোহ, বন্যা, দাঙ্গা, আদালেতের আদেশ বা সরকারী নিষেধাজ্ঞা বা টেকনিক্যাল বা প্রযুক্তিগত ত্রæটি বা নেটওয়ার্ক কাটা বা নেটওয়ার্ক ডাউন বা অযাচিত বাধা বা সার্ভার ডাউন বা অনিবার্য কারনে যদি সারাসরি অডিও-ভিডিও ও ভার্চুয়াল কনফারেন্স ও স্বাক্ষর সেশন বাতিল হয়ে যায় বা সেশন বিলম্ব হয়, সেক্ষেত্রে আপনি অনলাইনে পুনরায় আ্যপয়েন্টম্যান্ট নিবেন। সে পরিস্থিতিতে আপনি প্রত্যক্ষ বা পরোক্ষভাবে পরিশোধিত সার্ভিস চার্জ ফেরৎ বা কোন ক্ষতিপূরন দাবী করতে পারবেন না। করলে বা করালে তা অত্র সম্মতির ও রিফান্ড পলিসির শর্তভঙ্গ হিসাবে গন্য হবে এবং আইনত সর্ব আদালতে অগ্রাহ্য হবে। 

উল্লেখ্য, উপরে উল্লেখিত কারন ব্যতীত স্বাভাবিক পরিস্থিতে আপনি যদি প্রথম সাক্ষাৎকার তারিখে আপনি উপস্থিত হতে ব্যর্থ হন বা যেকোন কারনবশতঃ আপনি যদি আপনার প্রথম সাক্ষাৎকারটি বাতিল করেন, সেক্ষেত্রে আপনাকে প্রথম সাক্ষাৎকারে অনুপস্থিতির তারিখ থেকে পরবর্তী ১ মাসের মধ্যে অনলাইনে দ্বিতীয় এবং চুড়ান্ত সাক্ষাৎকারের তারিখ নেওয়ার সুযোগ দেয়া হবে। আপনি যদি নির্ধারিত সময়ের মধ্যে অনলাইনে দ্বিতীয় তথা পুনঃ সাক্ষাৎকারের তারিখ নিতে ব্যর্থ হন বা অনলাইনে দ্বিতীয় তথা পুনঃ সাক্ষাৎকারের তারিখ নেওয়ার পর আপনি যদি দ্বিতীয় তথা পুনঃ সাক্ষাৎকার তারিখে উপস্থিত হতে ব্যর্থ হন অথবা আপনি যদি আপনার দ্বিতীয় সাক্ষাৎকার তারিখটি যেকোন কারনবশতঃ বাতিল করেন, সেক্ষেত্রে যে সার্ভিস চার্জ পরিশোধ করবেন তা অফেরৎযোগ্য হবে। সে পরিস্থিতিতে আপনি পরিশোধিত সার্ভিস চার্জ ফেরৎ বা কোন ক্ষতিপূরন দাবী  করতে পারবেননা। করলে বা করালে তা অত্র সম্মতির ও রিফান্ড পলিসির শর্তভঙ্গ হিসাবে গন্য হবে এবং আইনত সর্ব আদালতে অগ্রাহ্য হবে। সেক্ষেত্রে আপনাকে অনলাইনে নতুন করে আবার অর্ডার দিতে হবে এবং পুনরায় সার্ভিস চার্জ পরিশোধ করে নতুন সাক্ষাৎকার তারিখ নিতে হবে।   

প্রথম বা দ্বিতীয় সাক্ষাৎকারের তারিখে যদি নোটারীবিডি সার্ভিসেস এর তালিকাভূক্ত নোটারী পাবলিক যেকোন কারনবশতঃ উপস্থিত হতে না পারেন সেক্ষেত্রে আপনাকে পুনঃ সাক্ষাৎকার তারিখ প্রদান করা হবে। সে পরিস্থিতিতে আপনি পরিশোধিত সার্ভিস ফী ফেরৎ বা কোন ক্ষতিপূরন দাবী করতে পারবেননা। করলে বা করালে তা অত্র সম্মতির ও রিফান্ড পলিসির শর্তভঙ্গ হিসাবে গন্য হবে এবং আইনত সর্ব আদালতে অগ্রাহ্য হবে।

উল্লেখ্য, উপরে উল্লেখিত কারন ব্যতীত স্বাভাবিক পরিস্থিতে Notarybd.com ডিজিটাল প্ল্যাটফর্ম ও এর তালিকাভূক্ত নোটারী পাবলিক আপনাকে যদি ইনভয়েস / বিল এ বর্নিত সার্ভিস যেকোন কারনবশতঃ সম্পূর্ন প্রদানে ব্যর্থ হয় সেক্ষেত্রে আপনার পরিশোধিত সকল সার্ভিস চার্জ আপনাকে সার্ভিস প্রদানে ব্যর্থতার তারিখ হতে পরবর্তী ১৫-৩০ কার্য দিবসের মধ্যে নিঃশর্তে আপনাকে ফেরৎ প্রদান করা হবে। সেক্ষেত্রে আপনি প্রত্যক্ষ বা পরোক্ষভাবে সার্ভিস না পাওয়ার কারনে কোন সুদ এবং / বা কোন ক্ষতিপূরন দাবী করতে পারবেন না। করলে বা করালে তা অত্র সম্মতির ও রিফান্ড পলিসির শর্তভঙ্গ হিসাবে গন্য হবে এবং আইনত সর্ব আদালতে অগ্রাহ্য হবে।

অত্র আইনী সম্মতি ও রিফান্ড পলিসির শর্ত আপনার দ্বারা স্বাক্ষরিত সার্ভিস গ্রহন ও প্ল্যার্টফর্ম ব্যবহারের শর্তাদির অংশ হিসাবে গন্য হবে।

অত্র আইনী সম্মতি ও রিফান্ড পলিসির শর্তাদি মেনে  নিয়ে ”আমি গ্রহন করলাম-এ ক্লিক করার মাধ্যমে আপনি সম্মতি প্রদান করছেন যে, অত্র আইনগত ম্মতি ও রিফান্ড পলিসিতে আপনার দ্বারা স্বাক্ষরিত আপনার ইলেকট্রনিক স্বাক্ষর আপনার কলম এবং কালির স্বাক্ষরের মত বৈধ ও তৎজন্য আপনি আইনগতভাবে বাধ্য থাকবেন।

Chargeback and Dispute Resolution Policy

We at Notarybd.com are committed to providing high-quality services to our registered users. We understand that sometimes, things can go wrong, and registered users may have concerns or issues with their delivered services or purchases. This policy outlines our chargeback and dispute resolution process for online notary services. We have put in place a comprehensive Chargeback and Dispute Resolution Policy to ensure that such instances are handled in a fair and efficient manner.

If you believe you have been wrongly charged or have an issue with your services or purchase, we ask that you contact our support team at [email protected] first to try to resolve the issue. If you still wish to dispute the charge, we request that you provide us with the reason in writing for the dispute and any relevant information, documentation and evidences that supports your claim.

Chargeback Policy:

1. A chargeback is a request for a refund of a transaction made by a registered user.

2. If a registered user wants to initiate a chargeback, he / she should contact our customer support team at the earliest possible time.

3. We will review the claim and respond to the registered user within a reasonable time frame.

4. If we find that the claim is legitimate, we will issue a refund to the registered user within 15-30 business days.

5. If we find that the claim is not legitimate, we will contest the chargeback with the appropriate authorities.

6. We reserve the right to suspend or terminate services for registered user who have initiated multiple chargebacks.

Dispute Resolution Policy:

      1. If a registered user has a dispute with our service, they should contact our support team at the earliest possible time           in writing. Please provide as much detail as possible about the dispute, including supporting information,                               documentation and evidences.

       2. Our support team will review the dispute and work with the registered user to find a resolution.

       3. If a resolution cannot be reached, we will escalate the dispute to our management.

       4. Our management will review the dispute and make a final decision.

       5. We will communicate the decision to the customer within a reasonable time frame.

       6. In the event that a dispute cannot be resolved through our internal process, we may suggest mediation or other                   alternative dispute resolution methods to reach a resolution.

       7.We reserve the right to suspend or terminate services for registered users who abuse our dispute resolution policy.
